1. Who we are and what this policy covers

Vybright, Inc. (“Vybright,” “we,” “us,” or “our”) provides software and related services for software development teams. This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, how long we keep it, and the choices and rights you have.

This policy applies to vybright.com and any subdomain we operate, to our developer preview and early access programs, to email and other communications you exchange with us, and to any product or service that links to this policy. It does not apply to any third-party website or service we link to, which has its own privacy practices.

If you do not agree with this policy, please do not use our website or submit information to us.

2. Summary

  • We collect the information you give us through our forms and emails, and a limited amount of technical information collected automatically when you visit the site.
  • We use it to answer you, to run our developer preview and early access programs, to operate and secure the site, and to tell you about our products.
  • We do not sell your personal information, and we do not share it for cross-context behavioral advertising or targeted advertising.
  • You can ask us for a copy of your information, ask us to correct it, ask us to delete it, and tell us to stop emailing you.
  • To make any request, email privacy@vybright.com.

3. Information we collect

3.1 Information you give us

We collect information you choose to provide, including:

  • Contact and inquiry information. Your name, email address, company or organization, job title or role, and anything you write in a message to us through our contact form or by email.
  • Developer release and early access registration information. Your name, email address, company or organization, role, and any details you choose to give about your development environment, tools, team size, or intended use.
  • Program and account information. If you take part in a preview, beta, pilot, or paid program, the information needed to set up and support your participation, including account credentials issued by us and records of support requests.
  • Job applicant information. If you apply for a role with us, the contents of your application, including your resume, cover letter, work history, education, portfolio or code repository links, and any information you provide in an interview. See section 15.
  • Communications. Records of emails, messages, calls, and meetings between you and us, including scheduling information.

Please do not send us sensitive personal information. We do not ask for government identification numbers, financial account numbers, health information, precise location, biometric data, or information about race, ethnicity, religion, political opinions, union membership, sexual orientation, or immigration status, and we do not want to receive it. We also ask that you do not send us confidential source code or other confidential material unless we have a written agreement in place covering it.

3.2 Information collected automatically

When you visit our website, our servers, our hosting provider, and any analytics or security technologies we use may collect:

  • Your Internet Protocol (IP) address and general location derived from it, such as country, state, or city.
  • Your browser type and version, operating system, device type, screen size, and language setting.
  • The pages you view, the time and date of your visit, how long you stay on a page, and the links you click.
  • The website or search engine that referred you to us, and any campaign parameters in the link you followed.
  • Server log information, including requests made, response codes, and errors.

We use this information in aggregate and for security. We do not attempt to use it to identify you personally except where we need to investigate suspected fraud, abuse, or a security incident.

3.3 Information from other sources

We may receive information about you from our service providers, from publicly available sources such as a company website or a public professional profile, from a colleague who refers you to us, and from partners who help us run events or programs. We combine that information with what you give us in order to understand whether our products are relevant to you and to keep our records accurate.

4. Cookies and similar technologies

A cookie is a small text file that a website stores on your device. We and our service providers use cookies and similar technologies, including local storage and small image files sometimes called pixels or web beacons, for the following purposes:

  • Strictly necessary. These keep the site working, keep it secure, protect our forms from automated abuse, remember your cookie choices, and let you move between pages. The site cannot work properly without them.
  • Performance and analytics. These help us understand which pages people visit, how they arrive, and where the site is slow or confusing, so we can improve it.
  • Functionality. These remember choices you make, such as language or display preferences.
  • Marketing and attribution. Where we run a campaign, these help us understand which campaigns bring people to the site. We do not use cookies to build advertising profiles about you across other companies’ websites.

You can control cookies through your browser settings. Most browsers let you refuse new cookies, delete existing ones, and warn you before a cookie is stored. If you block strictly necessary cookies, parts of the site may stop working. Where the law requires your consent before we set non-essential cookies, we ask for it before setting them, and you can change your choice at any time.

5. How we use information, and our legal basis for using it

We use personal information for the following purposes:

  • To respond to you. To answer questions, provide requested information, and follow up on a conversation. Legal basis: performance of a contract or steps taken at your request, and our legitimate interest in responding to inquiries.
  • To run our developer preview, early access, and beta programs. To register you, admit you, give you access, support you, and gather your feedback. Legal basis: performance of a contract or steps taken at your request.
  • To provide, operate, maintain, and improve our products and website. Legal basis: legitimate interests in running and improving our business.
  • To communicate with you about our products, including product updates, release announcements, and relevant company news. Legal basis: your consent where required, and otherwise our legitimate interest in marketing to business contacts. You can opt out at any time.
  • To keep our site and our products secure, to detect and prevent fraud, abuse, and unauthorized access, and to investigate incidents. Legal basis: legitimate interests in security, and compliance with legal obligations.
  • To understand how the site is used and to measure whether our content and campaigns are working. Legal basis: legitimate interests, and your consent where required for analytics cookies.
  • To evaluate job applications and manage our hiring. Legal basis: steps taken at your request before entering an employment relationship, and our legitimate interest in recruiting.
  • To comply with the law, to enforce our agreements, and to establish, exercise, or defend legal claims. Legal basis: legal obligation and legitimate interests.

We do not use your personal information to make decisions about you that produce legal effects or similarly significant effects without human involvement, and we do not use it for profiling of that kind.

6. How we share information

We share personal information only as described here:

  • Service providers. Companies that perform work for us and process information on our instructions. The categories are: website hosting and infrastructure; content delivery, backup, and site security; email delivery and email marketing; analytics and site performance measurement; customer relationship and contact management; document signing and file storage; scheduling; and payment processing where a payment applies. These providers are bound by contract to use the information only to provide their service to us.
  • Professional advisers. Our lawyers, accountants, auditors, and insurers, where they need the information to advise us.
  • Legal and safety. Where we reasonably believe disclosure is required by law, by a subpoena or court order, or by a government or regulatory request, or where disclosure is necessary to protect the rights, property, or safety of Vybright, our users, or others.
  • Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of all or part of our assets, including during due diligence, subject to confidentiality protections. If your information would be transferred and become subject to a different privacy policy, we will tell you.
  • With your direction. Where you ask us to share information or agree to it.

We may also share aggregated or de-identified information that cannot reasonably be used to identify you. Where we de-identify information, we maintain it in de-identified form and do not attempt to re-identify it.

7. We do not sell or share your personal information

In the twelve months before the effective date of this policy, and going forward, Vybright has not sold personal information and has not shared personal information for cross-context behavioral advertising or targeted advertising, as those terms are defined under California, Virginia, and other United States state privacy laws. We do not sell or share the personal information of anyone under 16 years of age, and we have no actual knowledge of doing so.

8. International data transfers

Vybright is based in the United States and our service providers are primarily located in the United States. If you are in the European Economic Area, the United Kingdom, Switzerland, or another country outside the United States, your personal information will be transferred to and processed in the United States, where privacy laws differ from those in your country.

Where we transfer personal information out of the European Economic Area, the United Kingdom, or Switzerland, we rely on appropriate safeguards, including the European Commission’s Standard Contractual Clauses and the United Kingdom International Data Transfer Addendum, together with additional measures where they are needed. You can ask us for information about these safeguards by emailing privacy@vybright.com.

9. How long we keep information

We keep personal information only as long as we need it for the purpose we collected it for, and then delete it or de-identify it. Our normal periods are:

  • Contact and inquiry information: up to 24 months after our last contact with you.
  • Developer release and early access registrations: until you ask us to remove you, or up to 24 months after the program ends.
  • Program, account, and support records: for the length of the relationship and up to 7 years afterward, where we need them for legal, tax, or audit reasons.
  • Marketing contact information: until you unsubscribe or ask us to delete it, and then we keep a minimal record of your opt-out so we do not contact you again.
  • Website server logs and analytics data: up to 12 months, except where a longer period is needed to investigate a security incident.
  • Job applicant information: see section 15.

We may keep information longer where we are required to by law, or where it is needed to establish, exercise, or defend a legal claim.

10. How we protect information

We use administrative, technical, and physical safeguards designed to protect personal information, including encryption of data in transit, access controls that limit who inside our company can see what, multi-factor authentication on our own accounts, service providers selected in part for their security practices, and regular review of who has access to what.

No method of transmitting or storing information is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident affecting your personal information, we will notify you and any regulator as required by applicable law.

11. Your choices

  • Marketing email. Every marketing email we send carries an unsubscribe link. You can also email privacy@vybright.com and ask to be removed. We will still send you messages that are necessary for a program you are taking part in or a service you have asked for.
  • Cookies. See section 4.
  • Information you give us. You can choose not to give us information, though some of it is needed for us to answer you or admit you to a program.

12. Your privacy rights

12.1 Rights under United States state privacy laws

Depending on where you live, including Virginia, California, Colorado, Connecticut, Delaware, Montana, Oregon, Texas, Utah, and other states with comprehensive privacy laws, you may have the right to:

  • Confirm whether we are processing your personal information, and get access to it.
  • Get a copy of your personal information in a portable, readily usable format.
  • Correct inaccuracies in your personal information.
  • Delete personal information you gave us or that we obtained about you.
  • Opt out of the sale of personal information, of targeted advertising, and of profiling that produces legal or similarly significant effects. As stated in section 7, we do not carry out any of these activities.
  • Limit the use and disclosure of sensitive personal information. As stated in section 3.1, we do not ask for sensitive personal information.
  • Not be discriminated against or retaliated against for exercising any of these rights. We will not deny you service, charge you a different price, or give you a lower quality of service because you made a request.

12.2 Rights under the GDPR and United Kingdom data protection law

If you are in the European Economic Area, the United Kingdom, or Switzerland, you have the right to access your personal information, to have it corrected, to have it erased, to restrict how we process it, to object to processing based on our legitimate interests, to receive your information in a portable format, and to withdraw consent at any time where we rely on consent. Withdrawing consent does not affect processing we carried out before you withdrew it.

You also have the right to lodge a complaint with your local data protection authority, or with the United Kingdom Information Commissioner’s Office. We would prefer you raise the matter with us first so we can put it right.

12.3 How to make a request

Email privacy@vybright.com with the request you are making and the email address or other details you gave us, so we can find your information. You may also write to us at the postal address in section 18.

We will confirm receipt of your request promptly and respond within 45 days. If we need more time, we will tell you within that period and explain why, and we may take up to a further 45 days. We do not charge a fee for a reasonable request.

We need to verify your identity before acting on a request about specific personal information. We do that by matching the information in your request against what we already hold, and for some requests by asking you to confirm the request from the email address we have on file. We will not ask you for more information than we need in order to do this. Where we cannot verify you, we will tell you and explain what is missing.

12.4 Authorized agents

You may use an authorized agent to make a request on your behalf. We will ask the agent for written permission signed by you, and we may ask you to confirm directly that you gave that permission.

12.5 Appeals

If we decline your request, we will tell you why. You may appeal that decision within 60 days by emailing privacy@vybright.com with the word Appeal in the subject line. We will respond to your appeal in writing within 60 days and explain the reasons for our decision. If we deny your appeal, you may contact your state Attorney General to submit a complaint.

13. Do Not Track and Global Privacy Control

Some browsers send a Do Not Track signal. There is no common industry standard for how to respond to it, and our site does not currently respond to it. Where the law requires it, we treat a Global Privacy Control signal sent by your browser as a valid request to opt out of the sale and sharing of personal information for the browser sending it.

14. Children’s privacy

Our website and products are intended for businesses and for professional software developers. They are not directed to children, and we do not knowingly collect personal information from anyone under 16 years of age. If you believe a child has given us personal information, email privacy@vybright.com and we will delete it.

15. Job applicants

If you apply for a role with us, we use the information in your application to assess your suitability, to communicate with you about the role, and to keep a record of our hiring decisions. We share it with our service providers for recruiting and scheduling, and with the people inside our company involved in hiring.

We keep application materials for up to 12 months after a hiring decision, so we can consider you for other roles and meet our record-keeping obligations, unless you ask us to delete them sooner. If we hire you, your information becomes part of your employment record and is covered by our employee privacy notice instead of this policy.

16. Third-party links and services

Our website links to sites and services we do not control, including code repositories, documentation hosts, social media platforms, and scheduling tools. Following those links takes you to a service with its own privacy policy and its own cookies. We are not responsible for their practices, and we encourage you to read their policies before giving them information.

17. Changes to this policy

We may update this policy as our products, our practices, or the law change. When we do, we will post the updated policy on this page and change the effective date at the top. If the change is material, we will give you notice by a prominent notice on the site or by email to the address we hold for you, before the change takes effect where the law requires it. Please review this page from time to time.
